Mr Annan takes instructions from UN members. He is not a rolling cannon with a mouth. He is directed to make policy statements on behalf of the UN and is the person who states the "official position" of the UN.
That is the function of the Secretary General.

I do not have any doubt in my mind that some members of the UN are of the "opinion" that the US broke either the charter or a resolution, but that is the point, it is some member's opinion. They can present a resolution in an attempt to make their "opinion" official and binding but they have not done so and until they do it is only the opinions of some members.
Much like criminal law, an accusation is made, a defendant is charged, a defendant goes to trial, but until the defendant is "officially" convicted, it is only the opinion of the prosecutor (and possibly the audience) that the defendant has broken the law.
