as far as i understood it doesn't necessarily matter that she is not nude or in any hardcore action, as long as she is underage and her images are used in a pornographic context. when her pics at 16 years of age are being sold next to pictures of cunts getting crammed with dick and other random sluts getting nuts busted on their face, i'm pretty sure her images are being used for in a pornographic context.
these programs have probably made millions off scraped images. they need to get hit hard and pay out heavily for damages, otherwise this is just a speed bump which they can pay out on and ignore. so long as the risks still outweigh the rewards,they will continue to do what they do.
