Found that out a few days ago when I received a spam email from a hosting company offering to host my new private WHOIS domain registered at Moniker.
It's the first time it's happened to me with Moniker, so I went and re-read their Privacy Policy before I complained, but after I'd read it I didn't bother to complain.
No point.
As you say, don't rely on Moniker for strong privacy.
