It's all about trademark and not uniqueness of name. As long as the US company does not have a registered trademark in Canada for that name, the Canadian is free to use it. I am not sure the US company could even register it as a trademark in Canada unless they were doing business in Canada.
So you will find some big companies like Toyota have trademarks all over the world for both their name and their logo and they qualify since they do business in the countries. But Jim's Place might be owned by a bar owner in London, and he may never register the name of his bar as a trademark and there could be a ton of people using the same name all over the world and it would be all perfectly legal.
