Affiliate thinks up new way to promote AWE, runs it by them in writing to check that it is ok, they reply that it is not specifically contrary to their terms but to check it is not against ebay's terms, he then proceeds with promotion, makes sales, and AWE refuse to pay out on some made up grounds.
Seems straight forward enough to me.

Yeah, this seems like Brad, who read the initial inquiry into how this guy wanted to promote, dropped the ball in this situation. Based on the initial email in the screenshot, this guy clearly wanted to generate new sales through incentivization (paying visitors to join via his link) which is a classic no no for just about every affiliate program. Brad should have told him "no" at that time. Instead of deleting this guys account, AWE should just convert him to revshare and let him continue to promote in the same manner. He'll find out real quick how profitable his sales are, not only for AWE, but to his own advertising budget.
