Pretty simple - you can't just cross a busy street where ever you want. There are laws about this. Cross a busy street recklessly and you get hit. In this case, the woman took her kids and just crossed the street.
Pretty fucked up that she got more than the drunk driver, but at the end of the day she is directly responsable for her child being hit.
