Which is a direct cut and paste from
http://headwaythemes.com/terms_of_service.txt with absolutely no additional notice of split licensing. The only reference to split licensing is in his 'rant' on their blog and in the comments. I don't deny he is the one who wrote the post, but it doesn't change what they have directly on their main site.
