For the most part I think they are. There are cases when obscenity charges have been brought though like the site who posted the video of the guy fucking the dead Asian he had killed and dismembered. Not sure what the outcome of that was. Last I heard the owner of the site had been on the run but was captured.
Edit: apparently it was the owner of bestgore who was arrested. Anyone know what happened in that case?
