I think the debate is more about "what is crime?"
Is crime a thing that requires a victim?
If there is no victim or potential danger/harm/loss then is an physical arrest needed?
Selling single cigarettes is not serious crime.
Apparently selling single cigarettes is illegal because it's less harmful to smoke a whole pack.
