Aside from this metaphor, Theporndude actually did commit a "crime" (for the Google guidelines of course, not an actual crime).
He actually got too many "commercial anchor text", and now that he has a dirty conscience, he fears them to look unnatural to Google eyes.

What is the crime he committed?
Imagine a site with 100K backlinks, and 50K of these are using the same anchor text "best porn sites". Google won't think that half of the total links sharing the same anchor text looks natural at all.
Google thinks that these links have been obtained artificially, by paying for them, or though some exchange, then the sites deserves a penalization.

Theporndude knows this, that's why he came up with this solution:

What are the issues?
- Theporndude took care of giving you the code to insert on your site, so that he could avoid to explicitly asks to omit the alt text, something you might have asked the reason for. So the problem is your partner's loyalty.

- You're keeping on each page of your site a link built to cover black seo tactics for another site.
Why should you risk to get a manual penalization and lose your work, due to another guy's shady tactics you don't get any benefit from?

- Each page of your site is hosting an image with no alt text, and often this image is the first one on the site. Aside the fact it may impact your site indexing, still theporndude did not warn you that using his code you was adding on each page of your site an image missing an important tag for Google.

Solutions (easy and quick to apply)
Possibly remove the link.
Theporndude showed countless times how his business is focused on trick Google rules and other webmasters, in order to get the best results for himself, despite what may happens to his partners.
Considering his recent penalization and his general behavior, he may not be considered as a good partner. Surely not somebody you can trust when it comes to setting up a deal or asking SEO advice.

Alternatively
- remove the image before the link and set up a branded anchor text (if the link is not in the main menu)
- remove the image before the link (if the link is in the main menu)

Let me remember to theporndude that: your only salvation would be to provide a clear answer to the allegations that have been addressed to you. Instead, since theporndude is a scammer and he can't reply with solid arguments, it's been months that he and his team keep posting funny comments, low-grade racist insults and large-scale images with the sole aim of hiding the truth (and this just confirms that these accusations are true). theporndude is a SCAMMER

PS: Checking this thread and the similar ones, can you see how much time does theporndude spend on covering these info?

During all this time, the best defense strategy he has found is: posting big size images...
