Pretty sure the case is based on the deceptive story of swimwear shoot, not on the fact they were promised no one would see their porn scene publicly, that is not important here.
Porn is porn, no matter if public or not.

The point is that they were , with the use of deception, induced to do porn. They travelled a long distance and when it turned out to be a porn shoot, they could not just say "no" due to the fact they needed the money to get back home. It doesn't matter what kind of porn. There is a civil case, that is probably based on breaching the contract/model release when they published the content - and that's why I believe many of those models originally even didn't know this was a criminal case, it just turned out to be after they filed for the civil suit.
