That is not enough to prevent a DMCA. If there is no license (Creative Commons licenses or whatever) the person depicted on the media can file a DMCA at any time, if they change their mind.
A comment like
"this pic is free and you can do whatever you want with it, no licence attached" imply the uploaders intentions at the time given, but nobody knows if the uploader is the person they say they are... so that gives zero value
