Pitfalls, legalities, consequences (and the future) of tube scrapers in 2020

It's 2020. We've all had several years to watch this unfold, and I'm curious to know what everyone thinks about it now and for the future.

The issue we all know well:
  • There's a proliferation of tube scraper scripts designed to suck content directly from the big, established tubes.
  • An overwhelming number of these scraped sites use custom players/plugins designed to circumvent the default (sanctioned) video players provided by the originating tubes.
  • So Pornhub, for example, ends up providing ALL the content, text, tags, categories, video bandwidth, streaming technology, etc — and then the offending webmaster removes and replaces all Pornhub's ads and links with his own.

Question #1: What are the originating tubes doing to fight back / prevent such theft? Is it worth their time to fight back?

Question #2: At what midnight hour does Pornhub/Adultforce reach critical mass and decide they don't need to offer video embeds at all – and merely replace all embedded videos with a "Watch this video on Pornhub" loop?
