A Swiss court has ruled that pornographic content featuring adults digitally altered to look underage is illegal, even if no real minors were involved.
The Swiss Federal Supreme Court upheld the conviction of a man who shared a video online that appeared to show a prepubescent girl. Investigators later confirmed the performer was an adult actress whose appearance had been digitally altered to appear underage using software.
The court rejected the argument that the content was legal because no real child was used. Under Swiss law, both real and digitally created child sexual abuse material are criminal offenses — including content altered with AI or other digital tools.
Judges emphasized that allowing such material would make it harder to prosecute real child abuse cases and warned that partial digital manipulation can make age verification even more difficult than animated or cartoon depictions, which are already banned.
Legal experts say the ruling sends a clear message: AI manipulation does not provide legal cover and technological advances won’t shield offenders from accountability.
