It sure would be interesting to see the contract. Seems to me the best thing for all parties at this point would be to simply terminate the contract. Yes litigation can be expensive, but it will be just as expensive for the plaintiff, and in this case and it appears we have a judgement proof defendant on the other end. She has a very simple and legal way out of the contract if she wants it. If her financial situation is as dire as she puts it (not enough to cover rent) all she has to do is file chapter 7 bankruptcy and the contract is over, and there wouldn?t be anything that could be done about it.
