You cant make a partnership plus an initial payment and then when you owe money later on, say that the money that the other person was paid via the partnership counts toward the new bill. Are u fucking high?
You made an agreement of 50/50. You didnt ask for any new promo material. You've admitted that. You cant at a later date come back and stop the 50/50 partnership, continue using the work and then when confronted about it say that you dont owe anything for using them because of the $$ you paid the partner for the initial agreement.
I know what you're saying. Fletch violated the partnership by not doing the additional promo banners therefor you dont owe him the $582. But one, you told him not too, and two, you cant pay someone for the patnership split and then later say the $$ went to something else.
If I were you I would be happy with the $500 offer and be glad you're not being sued for thousands.
