Liberty Media sues Hotfile.com

Quote:
...PayPal is also named as a defendant on the basis that it offers financial services to Hotfile, Titov and Lemuria. Liberty demands that the court freezes defendants’ assets held by PayPal pending the outcome of the case...

In respect of safe harbor, Liberty Media claims that while Lemuria had a registered agent as required under the Digital Millennium Copyright Act (DMCA) at the time of the infringements, Hotfile did not. As such it is “not entitled to the DMCA’s safe harbor provisions for the complained of infringements.”

Liberty describes Hotfile as a massive copyright infringer which encourages affiliates to upload copyright material in order to attract further visitors to its website from which both the company and affiliates profit.

With demands for a jury trial, Liberty Media claims Hotfile is guilty of inducing, contributory and vicarious infringement and wants statutory damages of $150,000 per infringed work.

Furthermore, Liberty requests that the court seizes Hotfile’s domain name pending the outcome of the case.

I believe this one is a very strong case. Unlike previous loosy attempts to pick on rapidshare, there's a good chance of actually winning this time (especially no registered DMCA agent is a strong arguement).

Sooner than later producers are going to start winning these cases. As the ball gets rolling more and more suits will be filed. Holding Paypal as a defendant is very smart in my opinion. They will do whatever they can to shed liability, and if you can cut the filesharers source of income, you're hitting them where it hurts. It's going to be a slow process, but I like to think that things are moving in the right direction for content producers...

Paypal will start looking very closely at who they do biz with, meaning stricter regulations coming down the pike which is fine by me. Cut off the means of collecting/distributing money and the piracy shit will die.

They should of looked closer a long time ago.

Hitting the money sources is the best way to curb piracy. Making processors and advertiser responsible for where they do business will cut piracy down to a minimum. What's the point of putting up a site and paying for it if it loses money?

I doubt it.

If that were the case, they would not have been accepting payments in regards to Rapidshare that has been going on the better part of a decade, despite Perfect 10 repeatedly suing them.

You'd be surprised at the number of sites and hosts out there who do not have these on file.
Hint: Swift Communications (http://swiftco.net/) and Youjizz/Jizzhutt/Jizzonline/Jizzbo (Not JCI) Have a look here: http://www.copyright.gov/onlinesp/list/a_agents.html

so fuck the concept of innocent until proven guilty punish them BEFORE liberty media even proves their case

why can't a parent corporation act as the single agent for all it subsiduaries

this seems like the we don't have to care about fair use/dmca we are suing for unfair trade practices bullshit that got bitch slapped down by the court (something you also said had a really good chance of winning)

they should have, but years ago they lacked the proper angles of attack, or i should say knowledge of those angles.
now companies have the smarts and hindsight needed to get the job done.

This is not 10 years ago. This is not 1 year ago. This is now.

The fateful day is nearing when paypal will have to belly up to the bar for a strong shot of reality.

They are in the spotlight and this scrutiny will continue to grow as more and more cases emerge.

This is the next wave of attacks on piracy, and the surf is up

paypal is a money exchange making them responsible for the actions of a merchant is a fundamentally bad precedent to set

simply put that could never had been done if the original porn had been produced.

why not hold every one of you guys to the same legal liability that your claiming paypals should be held too.
