I would guess it is because after the ICANN meeting which opens the door for 1000s of new TDLs, the dot XXX strangle hold is gone. We will soon enough see dot porn, dot sex, etc... How's the govt or any other person going to tell me I'm not allowed to have porn on a dot porn domain to protect the children...

Interesting observation. I never considered this.

All the time and money spent on .xxx did seem to be with the goal of eventual mandatory use legislation.

From business stand point, it was a great idea for them right up until ICANN spoiled their party and said anyone with $180k can have a TDL, that must have really stung after the millions were spent...

Yes, that's why they wanted an stld instead of waiting for a gtld.

Because we managed to delay the approval of their stld for several years and the new gtlds are on the horizon, things are starting to look pretty good for us and pretty bad for the ICM.

if they had been smart and priced .xxx domains at $1 they might have had a few supporters to push their agenda.. THEN partnered with isp's to make .xxx mandatory and cemented a future..

they got greedy.. now they will fail

im sure you may run into trouble if you try to regsiter .facebook TLD

but im not really sure on how it all works. I figure most of the TLD's registred would be for like big companys like ebay who may want something like motors.ebay and stuff like that

and the ppl that go after say .porn - i doubt they will have a trademark issue as i dont think "porn" is trademarked? I could be wrong but i dont think you can trademark such broad words like that

It's not quite that simple, unfortunately.

$185k is just the application fee. You pay that for the right to be considered as an operator of the new gTLD that you propose. Paying that fee is the first step, but it's far from being the last one, or the only one, required in order to get set up as a gTLD operator.

Once you've applied for a new gTLD, there are challenge mechanisms in place that can be used by relevant stakeholders and/or rights-holders, the GAC, operators of existing TLDs that your newly proposed gTLD arguably competes with (in the case porn-related gTLDs, this would be where ICM Registry fits in), or even members of the general public.

If your proposed gTLD goes through unchallenged, none of that really matters, of course... but does anybody really believe that .porn or .sex would sail through unchallenged? I sure don't think so. I suspect that any broad-ranging, adult-related gTLD will be challenged by ICM, and by many of the same groups that opposed .XXX, including the GAC, and anti-porn organizations like Morality in Media.

For the sake of argument, though, let's suppose your application for a porn related gTLD goes unchallenged. Even then, you have more fees and logistical challenges ahead of you before you are anywhere close to running a new gTLD.

Even if nobody challenges your application, there is other criteria set by ICANN that you have to meet. (See the gTLD Applicant Guidebook for details on those requirements). If you clear those hurdles, and you application is granted, then you have to pay the quarterly "Registry Fixed Fee" (which is $6250/quarter, so $25k/year) and possibly other fees as well.

The fees themselves do not involve such a huge amount of money that they are beyond the means of a good-sized company (or a wealthy individual, I suppose) to pay in order to establish its own gTLD.... but the fees are just the tip of the iceberg where the costs are concerned. This isn't like tossing up a new domain on your server; you need to have, or acquire in timely fashion, the technical infrastructure necessary to operate the gTLD, as well. I'm sure that could be outsourced to a third party, but not without paying a pretty good chunk of change for their services.

So... it's not as simple as cutting a check to ICANN for $185k one day and rolling out .PinkVisual a few weeks later, I'm afraid. ;-)
