Yes image hosts business is big enough. Is a small screen capture image as infringing as a dvd rip or .iso of a software, which is 100% same as original?
I see that for music, a very low quality audio of a copyrighted song (for example a re-re-broadcast radio->webcam->internet which sounds really bad), it could be safe, because "quality it is so bad, that it does not give the same feeling of the original", some judge said in a few countries. Same argument it could be said of video thumbnails, which are resized and just few frames, so "only a preview" or "not giving same feeling of the original".
There was perfect10 to sue google for displaying preview thumbnails, there also google said hey but that's so smaller are you joking, it is only a preview.
Or couse uploading the full size photos of a photo site would be different but a quite small % of their business, main one is screencaps of covers or video contents.

Other way to argue with an image host, even if vidcaps can not be considered piracy on its own being "not give same feeling of original", it could be these facilitate the file locker with the full content, but, the image host may say they don't know if screencap is used for legal or illegal previews, in fact this is not easy to determine really.

Most if not all of the image piracy sites also host full sized photos that are 100% the same as original. For producers and paysites which offer mostly photo content (such as Met-Art or Femjoy) image hosts are even bigger problem than file hosts.

The fact that some do observe it is simply convenient for the purposes of anti-piracy efforts however it is not guaranteed.

Each country has it's own copyright legislation, it varies from jurisdiction to jurisdiction whether or not this legislation can be effectively enforced in the online realm. Ecatel are only required to follow the laws of countries in which they have an effective residence or place of business.

It is very important to be very precise about these matters and spreading incorrect information is unhelpful as it leads people to adopt a view which is not consistent with the facts.

On the matter of a site using a CDN, this is not a factor in determining liability with regard to copyright infringement. In law the liability resides with the publisher and any party republishing content. If a CDN consistently republishes content then, unless it is afforded carrier status in a particular jurisdiction - such as the carrier status protections afforded in Australian law - then the CDN is just as liable for republishing the content.

And also always cc them to copycontrol, to be used as evidence to demand termination of the infringing site, or termination of a rogue billing company which is processing payments for such sites.

Do not send DMCAs to hosts, unless you're happy spending most of your time scouting forums and blogs for links and playing cat and mouse game with the upload monkeys. Do not settle on merely killing some links. Help to kill file lockers which are the reason why links to your stolen content appear at piracy/warez sites.
