So what was the lawyers reason for dropping you. There has to be a valid reason for a public defender assigned to your defense to drop you days before a scheduled trial.

I am going to try to challenge all of this. Proper representation is a right. I'm sure who ever they give me has never won a case similar to this. That's not proper representation. I'm done being pushed around. It's getting ridiculous now

hopefully you've been studying up on the law surrounding your case and in general, so you can go in and calmly and STRATEGICALLY represent yourself and the fact that your state-appointed attorney was under contract which was effective blah blah, you get what i am saying right?

You can all say what you want, but you better hope and pray that the slot machine never decides to fuck with YOU. Was I tired? Yes, I'd been awake 3 days. Was I drunk? Fuck no, I drove 40 minutes on a curvy highway at over 120mph on the way home. Who the fuck could do that while under the influence of alcohol? I even have video of how smoothly and perfectly I pulled over and the officer admitted on audio that I did very well on the field test.

It comes down to I'm white and I'm poor so I am fucked.
I've already been a year without being able to drive.
Now they think they need to put me in a cage.

There are literally thousands (2000-3000) of compounds possibly present in human breath that will set this fucking thing off. Not to mention the fact that if you have anything stuck in your teeth, it'll measure mouth alcohol and go off on you. Not to mention the fact that the manufacturer has been sued by several states for things ranging from not disclosing the source code (no one, even the states, know HOW this thing works) to outright making faulty half assed modifications to it. Not to mention the fact that the calibration procedure is extremely touchy and difficult. Not to mention that if your body is not "average" it'll be way off. Not to mention the fact that florida and several other states had to throw out a pile of cases because of this piece of shit. Not to mention the fact that here in this state, a few counties over, a prosecutor there refuses to even use this machine as evidence, not to mention the fact that in this type of case you're presumed to be guilty rather than how it works in any other type of case, not to mention the fact that courts in the states are not supposed to be allowed to prosecute a victimless crime



If I had money for a proper defense they'd have to leave me alone. I was not drunk. I was not impaired. Even if I was they sure as hell have not met any reasonable burden of proof. This should be dismissed based on the perfect parking and the passing the fst. But even then, I'd still be fucked on the driver's license. When they can destroy you using a slot machine shit has gone TOO FAR.

No I don't. I know I put myself in the position I am in. They could not have pulled me over if I wasn't driving extremely fast.

But, there should be some limit to what they can do to me without proving anything, for fuck sakes. This is ridiculous.

The only real shot I have at this point is to try and represent myself in front of a jury. At this point I know more about dui cases than whatever "lawyer" they're going to give me.

I have a 1% chance of winning the case. But juries are human beings and I just have to hope to christ they'll listen to me and that the prosecutor doesn't rip me to pieces with trickery

I have learned a big lesson. Don't put myself in a position like this, because I was a real dumbfuck to do that. Then, don't ever be white and poor. Then, don't have a black last name and be god damned sure that you have the best lawyer you can possibly afford.

I swear to you, if I ever have anything again, a huge piece of it is going toward having a legal team ready to defend me. Even though I don't plan on doing shit wrong anymore.

All I care about now is having good lawyers, good insurance and good doctors.
Not sure I will ever have any of that again- but- it's what will come FIRST.

But that raises a different issue. I thought in Kansas a DUI was usually a misdemeanor and that you could only get a public defender for a felony. Did they hit you with a felony DUI? I thought you had said somewhere that it was your first one?

Not meaning to be nosy but this is a story that is a year old now and it would be unfair of you not to give us a conslusion, ya know?

THAT is completely not true.
You can't convict someone of driving under the influence of alcohol for being tired.

I know that if you're 15+ over the speed limit and you kill someone, it automatically makes it manslaughter.

DUI is a misdemeanor here. As I understand it, you have a right to representation if you're charged with anything they can incarcerate you for a certain period for. I think it's 1yr

Why would you ever post any incident that could possibly get you jail time online? Why would you ask for advice online instead of calling another attorney? And be it on a porn forum.

If you were driving reckless like that and continued to act in such a manner to disrespect the road and other drivers safety then I have no solution that you want to hear.

I understand people do drink and drive and they do it daily. But having a few beers and driving home is a bit different than driving 100+ miles an hour after partying for days on end.
