Is it content theft if ...

Is it content theft if someone downloads a video from a tube site and uploads it to his own tubesite but respects the original watermark (so he does not remove this watermark)

If the answer on the question above is yes, how is this different from including videos from another site, which imho is worse, because the other tubesite is receiving your traffic bills.

I wouldn't think so. Youtube is designed as a sharing site. If someone uploads their video to Youtube they can expect it to be shared (hopefully using Youtubes links).

The problem is if someone downloads a Youtube video, removes the watermark and uploads it as their own.

Or

Just uploads it as their own, the watermark is irrelevent.

yes normally you has to use the embed function. No matter what tubesite you using. But you can making bucks from selling ads or use affiliates.

I also have this problem someone stole my video from my site where I have exclusive videos and posted 2-3 of them in a free blogspot and shared them for free. That's annoying and abusive and shows no respect to someone's work.

The difference lies in whether the file resides on your server or someone else's. One violates DMCA, the other does not. Do not upload anything to your server that you do not have the proper rights or permissions for.
