Are amateur videos copyrighted?
I'm wondering if I can use amateur content from let's say xtube or xhamster on my own tube site? Is it against DMCA rule?
I'm mainly thinking about cam videos. |

All "original work of art" is automatically copyrighted.
It's just a question if the level of originallity reaches high enough to deserve the protection of the law. A recording would, in most cases, more or less automatically qualify since it is about that unique, original person/character that is in the movie clip. So no, you are not allowed to just take them.
