I'd like the opinions of attorney's and/or those who use theirs frequently

Gentleman, & Ladies,
I have a simple straight forward question. On average, how many billable hours does it take (you), an attorney, to write an NDA? 2-3 hours? 4-5? 6-12? Fellow webmasters and program owners, on average, how many billable hours do you get charged for an NDA? I'd really appreciate any and all input on the subject.

It depends on the NDA you want. Will it come off a computer or need to be written from scratch and how many pages?

You're asking "How long is a piece of string?" question. No one but your attorney can answer it after he knows what you want.

2-3 for an experienced attorney unless you are in a very unusual niche biz/product here in the USA is more than enough (My Ex is one).

There are some very tight NDAs available as examples - it takes 1 hr to customize them. For domestic low revenue projects, customize your own. For international, high money, litigious counter-parties, or unequal relationships (you and Goldman Sachs, for instance), you should provide your attorney with all the relevant data, tell your attorney about the desired outcome in detail, and expect to pay for 8 hours.

As some have stated, it depends on the complexity of the NDA.
To save time and have a clearer understanding of what we expect the final document to read like, we always gather up existing agreements from the internet first. Specific notes from our side will show the lawyer what we are looking to add, remove or modify.

Billable hours easily adds up when you factor in the amount of time it took to read and respond to your email, research specific clauses and see if they legally can be applied to your situation and jurisdiction, implement the wording, etc.

Another area we control the costs is the hourly rates. We have negotiated agreements with certain lawyers to pay a different rate for different types of legal services. I believe the set rate is 125 USD an hour for drafting legal documents.

NDA are more bluff than bite in most cases -- if the agreeing party breaches would you really sue him?
So, it depends on what is disclosed as well its value and the collectability of the other agreeing party.

Barry is correct ... as usual.

It is difficult to prove the breach and directly connect it to the disclosing party.
Whatever you meant to keep private, most often becomes public record when you follow through with a lawsuit. Also determining a dollar amount for damages caused by the breach is also challenging.

Recognize the weaknesses in advance, should encourage people to draft more specific NDAs, and include mutually agreed to monetary damages, etc.

To be clear i'm not talking abouf what if someone breaches it. The question has nothing to do with the other party. For instance, let's use a sale as an example. For sake of argument we will use two US companies. They are merely talking and comparing each others numbers to see what options that opens up or closes off. The NDA is simply about not disclosing the numbers. Pretty straight forward. IMO. If an attorney told you it would take 12 hours, heck even 8, for something this straightforward, would you think this guy is a ripoff artist and padding the bill like a tranny hooker putting dish sponges in his bra. Discuss

According to our in house legal counsel, if you are building on an existing NDA, its an additional 2 hours max for research, and incorporating the additional required conditions.

I sincerely hope you are kidding about the 8 to 12 hour quote.

No that would not be the case in this hypothetical scenario. It would be more like this: company b has an interest in company a in an email to attornwy. Attorney would reply with, let's say, asking for the names of the parties involved. Nothing more.
