The monkey used a tool (a camera) and mimicked the human behavior observed apparently. That shows the intellect of a human toddler perhaps. The monkey gets 25% of the image revenue -- the monkey played an active role in the photography (<producing a selfie>)

The deer cannot work the camera -- the monkey did -- you miss the whole point.

That is the difference between an animal and a monkey. Monkeys have a thumb (like men do) and can use tools (like men do). Monkeys also throw poop -- men have evolved to talking shit (more or less the same behavior) :P

The photographer won the lower court cases... monkeys cannot own copyrights.

He now owns the copyright free and clear and has agreed to donate 25% of the future profits to PETA...

PETA settled because they know they were going to lose and wanted to get something out of it. The photographer settled because he was broke...
