DMCA for a headless image

I just got a takedown notice for an image of a naked woman cropped from the neck down. It is in an affiliate gallery of images from a well-known amateur site.

I've been targeted every once in a while by a scammer wanting an image taken down and I usually do it. Better safe than sorry.

But this seems a stretch. First, how would you even find an image like that, much less prove it was yours?

I'm going to take it down, but I think it's just a bullshit move.

Thoughts?

My scanner threshold is 25% using Amazon Rekognition. So it will identify the image as a match, if I can see half the body in a std resolution. I can even output the watermark in text, so I have a database on what assholes that reupload the image with a new watermark.

Chances are it's like you say.

But you can test reverse image search for yourself to see if your cropped image of the model's face brings up other images of the same model.

Sometimes it does, sometimes it doesn't. Might be a way some zealous DMCA outfit looks for targets.

I received a dmca for a close up of a dick. there was no way anyone could identify that person from the picture..but hey, if someone doesn't want their common dick on the internet, who am i to say no?

DMCA isnt about who appears in the photograph.

DMCA is about who owns the copyrights to the photograph/video... even down to a pixel level.

If you were legitimately using the image with the permission of the copyright owner, then why wouldn't you just send a counter?

i am also not an attorney but i would 100% counter that.. specify the affiliate license and source of use
