A federal judge ruled Friday that Visa helped Pornhub “monetize child porn” and sex trafficking — a decision that could have long-lasting implications for credit card companies, legal observers say.

The court denied Visa’s motion to be dropped from a lawsuit against porn parent company MindGeek, ruling there was enough evidence to show the company “knowingly provid[ed] the tool used to complete the crime” of distributing child pornography.

The decision was made in connection with a suit filed by a woman who claims Pornhub dragged its heels after she warned it was hosting an explicit video taken of her when she was 13 — at one point requiring photographic evidence that she was the same child in the video.

After several weeks, the clip, entitled “13-Year Old Brunette Shows Off For the Camera,” was taken down but reuploaded on other MindGeek sites in 2014, garnering millions of views and earning the company advertising money facilitated by Visa, the victim alleged. The illicit clip was still on the company’s sites as recently as 2020, according to the suit.

The plaintiff fell into a deep depression, tried to kill herself and became a heroin user after her unwanted infamy, she claimed. Still underage, she began acting in other porn videos produced by an older man to support her habit, the lawsuit said.

In his ruling, US District Court Judge Cormac Carney wrote that there was enough evidence to find that Visa engaged in a criminal conspiracy with the online pornographers.

“Here is Visa, standing at and controlling the valve, insisting that it cannot be blamed for the water spill because someone else is wielding the hose,” Carney wrote.

By the way, when it comes to CP, this is part of the intended damage. The material itself is used as leverage to control the victim into their adulthood.

Child advocate, attorney and true crime author Andrew Vachss ran across this in his cases and noted it in his books. Visa should have washed their hands of PH long ago.

I just wish the same logic and responsibility was applied to all companies (ad networks, cam sites...) that use VISA and sponsor piracy sites at the same time.

I think this will be appealed/thrown out/lost/whatever because if a card company can be liable for processing illegal things, this will go way beyond internet pornography into nearly every aspect of life as we know it.

Without reading the original complaint or the filed responses, my knee jerk reaction to the Judge's decision is "fan-fucking-tastic". Visa has merchant rules in place, which they failed to enforce. PornHub's alleged actions and failures were not one time missteps. Visa were enablers, and should be held accountable.

In the bigger scheme of things Visa will likely pay a relatively small fine, and will bring about harsher more unreasonable policy changes that will effect the small and medium size businesses that must comply or else. Its unfortunate that this industry failed to self regulate.

Sadly, the lawsuit can still be tossed. I guess it will depend on how the plaintiff's lawyers respond to the Judge's questions.

Very likely.
They can get over it with their great lawyers and PR specialists, make an apology for not seeing it earlier and showing that they started to be a lot more restrictive since 2020 with the PH affair and they'll get even stricter, that from now on it's blablabla zero tolerance blablabla and they'll manage.
And they actually got a lot stricter, requiring proof of models being 18+, having all docs, and all... and it's actually a lot more work for everyone already, but we all comply and that's ultimately healthy for the industry.
