Supreme Court Upholds Texas Age-Verification Law

This might have a huge impact on our indsutry.

The U.S. Supreme Court has upheld Texas’s age-verification law (H.B. 1181), ruling that it only incidentally affects free speech and passes constitutional muster under intermediate scrutiny. Justice Clarence Thomas argued that states have the right to require proof of age before accessing sexually explicit content online to protect minors, even if it imposes some burden on adults. This decision significantly impacts the adult industry by legitimizing mandatory ID checks for users, raising serious concerns about user privacy, site traffic, and compliance costs. Critics, including Justice Kagan in her dissent, warned that the ruling lowers the bar for regulating adult content and contradicts previous free speech precedents.

I believe that this will have significant and lasting effects on the industry. An excessive burden will be placed on site operators who wish to comply with these laws, and customers who just wish to support an industry. XBiz has reported numerous sites being sued earlier this year for non-compliance.

I am glad that I spent the time last, and this year, reading the documentation and learning all of the various Age Verification and Know Your Customer solutions. LoginBlue already has a release candidate to integrate them.

I think there are methods to weather this storm by shifting marketing plans and business direction. I've seen a few people on this forum (and some of my clients) already start adopting these plans.

I liked Kagan's dissent, and in following the various adult-oriented attorneys on Twitter, I think there is a lot of disappointment in today's ruling.

Look in the mirror and stop pointing fingers at regulators. If we had stayed wrapped up in plastic bags on the top shelf, this would probably have been overlooked by a lot of wives of legislators.

BTW, I have been pounding this drum for the last 20 years and you all just carried demolishing our business.

I hear you, and you seem to be correct, though I don't think many had a choice but to compete.

However, we still getting what we voted for.

I haven't read the regulations but does non nude enticing content actually qualify for an exemption?

This is a silly argument. Everything you say about the effects can be true but 0 people here had the ability to stop it. Everyone here goes pay to play only and some dude in Estonia becomes a billionaire. The "game was over" when YouTube got big, all of this was inevitable. Copyright laws adapted, life went on, anyone boycotting what happened missed out on their share of billions.

If they entire industry was PPV do you really think you could compete with OF models that send me videos of them fucking 2 girls in Facebook messenger to promote their own content?

This industry hasn't even had to deal with "react" content like mainstream. What are you going to do when people start taking paysite content and reacting to it on an adult style Twitch website? Skip another 20 years of revenue?

it's not just one set of regulations, it's different per state and there's around two dozen states with these laws.

my content currently is not much different than a Victoria Secrets catalog or a S.I. Swimsuit Edition magazine.

without shutting down entirely, I think I've taken a fairly cautious approach. I'll see how things progress and if needed redirect traffic from some states. worst case I'll just redirect USA traffic entirely but that would destroy my traffic trades and sales.

Yes, I do. Remember, this was before OnlyFans, which proved that people will pay for adult content if the platform and tech make it seamless.

But let’s be honest: anyone today can find extreme content — even the most vile, taboo, or outright illegal acts — in a few clicks. It’s disturbingly effortless, and even minors can stumble onto it. The industry didn’t fight this flood of free tube content; it eagerly embraced and encouraged it. It was like surrendering to Donald Trump — driven by fear, greed, or plain ignorance, and paving the way for chaos no one wanted to own.

OF generates billions in revenue per year, it's actually insane how much they've expanded the porn market. Almost as insane as almost nobody "in the industry" cashing in on it. It has never been easier.

So, what you're saying is that a pay site is making money and not supporting thieves?

It was inevitable. It should've happened sooner.
It costs cents to verify each user. This will reduce piracy in the long run..

I'm saying the industry is worth billions and a bunch of idiots took their balls, cries and went home instead of dealing with change.

What exactly do you accomplish by complaining about Tube sites when the results of banning them here would have put them all overseas with more stolen content and less sharing? DVD's sold well when there was no internet and VHS sold well when there was no DVD but none of it matters.

Justice Thomas would have been willing to show id to buy or rent Long Dong Silver? And have that id stored digitally forever.

We've come a long way.

X and Reddit will benefit the most...they will be the biggest porn websites soon.

You can access them even in countries that banned porn completely, which people over there do.

I’m beyond complaining. Now just observing and commenting. The flaw in your argument? DVDs and VHS sold; they weren’t dumped online for free to chase clicks.

The real problem wasn’t overseas pirates — it was immunity at home. Section 230’s 26 words gave platforms cover to profit off stolen content without consequence.

If distributors and search engines had been held accountable early, the mass theft wouldn’t have exploded. But instead, the industry, FSC included, backed the free for all, calling it “adaptation” while gutting its own value.

But the elephant in the room is, that the whole biz has an Achilles heel that could shut us down overnight if they really, really wanted us gone. We all know what that is...Visa.

Made my tour nude only, hope it's enough. Would do non-nude but would be a lot of work.

Just in case, we already should find and list offshore hosters, because most users simply won't do a face scan.
