You forgot to mention that the tripping was done by smacking the "sausage" in the head with a bat.

While not hard or malicious, it was still a bonehead thing to do.

definitely should get a misemeanor battery charge, and the pirtates should suspend him for a game. Cant swing a bat at someone, no matter what the intent. They tripped, fell, could have hurt a knee or ankle.
