LOS ANGELES ? A photographer accused of trying to extort $3.3 million from Cameron Diaz (search) for pictures taken before she became famous must stay jailed or pay a high bail amount.

Superior Court Judge Ann Jones on Wednesday said John Rutter (search) of Los Angeles must remain jailed in place of $250,000 bail.

In a related matter, Diaz has sued Rutter in civil court to keep the photographs from being published. That case begins Friday in Santa Monica Superior Court before Judge Alan B. Haber.

Rutter, 41, faces felony counts of attempted extortion, attempted grand theft, perjury and forgery. Last month, Rutter was denied release on his own recognizance and a court commissioner ordered him to stay away from the 31-year-old actress.

The photographs taken around 1992 are being held in a safe deposit box. Diaz's lawyers have declined to describe the photos and are asking for an injunction to keep them from being made public.

Rutter has said he contacted Diaz's attorneys on June 23 to offer them first right of refusal for the photos before trying to sell them to media outlets. Soon afterward, he said, authorities raided his apartment and seized the photos. He was arrested Aug. 12.

A publicist for Diaz has said the actress didn't sign a photo release at the private modeling session, and a release that Rutter produced is a forgery.

Rutter's mother, Mary Rutter, said after the hearing that her son was "not trying to hurt Cameron Diaz. Somehow, we have to see justice done."

Diaz, co-star of the "Charlie's Angels" (search) movies, "Gangs of New York" and "There's Something About Mary," is listed in the 2004 Guinness Book of World Records as Hollywood's highest paid actress with earnings of $42.2 million in 2001.

Just me doing it won't make a lick of difference, but when stars do things which make them less attractive, they are less able to open a movie, and overall will command smaller salaries. As I first heard this story from a fashion photog friend of mine, I know that it is not just adult internet people on gfy who think what Diaz did in this instance is very unattractive.

I could see trying to halt the release of the pics, but I don't know about the guying being held and being charged with extortion. It would be nice to know all the real circumstances. The biggest question really lies in who has legal ownership of the pics in question. And in the past as we've seen nude pics haven't hurt many actresses careers in fact many it may caused them to be even bigger stars.

Assuming the release is a forgery (ummm sure).

The photographer owns the copyright i.e. the pictures.

The model owns the likeness rights i.e. the right to make money off of them.

Under any standard release the model gives over that right to the photographer (right to profit and other things).

She obviously was present at the shoot. Now fun question is once you reach celebrity status you ussually give up certain rights pertaining to your likeness being used. I.E. tabloids, razzi, etc. So is a release needed?
