I am invovled with a celeb domain name .. the caleb has passed away and it is a messy battle ( kb should know about this one )

anyways - the domain is whois gaurded

they are sueing " whois guard "

lawyers are retards, instead of taking the obvious approach (contacting the owner and politely asking) they take the give it up now or i'm going to sue your ass. which 9times out of 10 would make any domain over think fuck you, bring it on.

Whois guard already gave it up but on the lawsuit they are sueing

the celebs name isnt trademarked yet ( they just started the process ) and this domain was given to us by the celeb its self YEARS AGO and it has been a site for awhile so our lawyers are saying we have a leg to stand on

Years ago (before the ruling on cybersquatting) I snagged the domain montgomerywards.com

Their lawyer contacted me and immediately copped an attitude toward me and tried to tell me what I was going to do and what I wasn't going to do - so I pointed the domain to jcpennys.com - I think he blew a gasket when the CEO of Montgomery Wards saw that!

I emailed him and told him that if he didn't take such a tone with me and treated me with a little more respect - these kind of embarrassing events wouldn't have happened. They wound up buying the domain from me for 10 times the amount that I really would have taken for it - punishment for being such an asshole to me


The NFL tried the same approach with the domain quarterbackclub.com (this one I was actually going to do something with). After many threatening emails and rudeness I'd finally had enough and (I'm not joking or elaborating here) told him to unzip my pants and take me to the back of his throat before I'll release the domain to the NFL.

I've never heard back from him and to this day - still own that domain!

In both instances - just a little niceness would have resolved the issue....

Well, if it's like you say they have no case.

If you REGISTERED or OWNED the domain before the TRADEMARK was issued, they can't legally do shit to you.
