I think an important question is: What constitues a record?
For example:
Someone adds a new title with eight performers, all of whom are already in the database.
And as you say, the program can "Attach stored performers to new depictions via simple drop-down menus."
So is new title that one new record @ $1? Eight records (one for each performer)? Nine records (One title and eight performers)?
What if the new title is on five URLs? How many records is that? Still one, eight or nine... five records (# of URLs with the new title), 40 records (eight performers on five URLs)...etc??

Not trying to bust balls...it's a serious question that I think is unanswered on your site or in your post and would make a big difference.

Hi Mike,

The laws and regulations are complicated, but the upshot is that a record must be created for each performer that appears in any given depiction. As explained in our FAQ:
  • What is a "record"?
  • A record is defined as one instance of a performer appearing in a visual depiction.
  • Can you give me an example?
  • Suppose you have one visual depiction involving two performers. That would be a total of two records.

Let's look at the rules. The regulations require each record to contain the following:
  • The legal name and date of birth of each performer;
  • A legible copy the performer's identification document;
  • A copy of the depiction;
  • The date of original production of the depiction;
  • The title or identifying number of the depiction;
  • Where published on the Internet, a copy of any URL associated with the depiction. If no URL is associated with the depiction, the records shall include another uniquely identifying reference associated with the location of the depiction on the Internet;
  • Any name, other than the performer's legal name, ever used by the performer, including a maiden name, alias, nickname, stage name, or professional name.

But that is not the end of the inquiry. Each performer must be indexed by the title or identifying number of the depiction, and their records must be retrievable by both the performer's name (real or assumed) and the title or number of the matter.

With that in mind, let's look at your first question:

To answer your question, our drop-down interface allows you to add existing models without re-entering all their information and re-uploading their ID documents. As explained above, the regulations require the creation of a new record each time a performer appears in a depiction. So under the regulations, the facts you presented would require eight records -- one for each performer in the depiction (even though the performers are already in the database). The total fee for storing and indexing these records under our service would be $8.

You also asked:

  • Suppose I shoot a scene involving three performers. I take 800 photos. I publish these 800 photos on my website in random groups of 10, which gives me 80 pages of content. What do I do?
  • Under the laws and regulations, a record must be created for each performer in a depiction. So regardless of the number of pages or photos, this example would be one depiction with three performers -- and thus only three records.

So to answer your question, the number of URLs would have no impact on the number of records.

Thanks for the answer...I'm sure I'm not the only one who appreciated it.

One clarification, though....when I said "five URLs," what I meant was placing the same depiction on five different websites (and not five different URLs on the same site).

So if I place the theoretical title with eight performers on five different websites - would that still be eight records - or would it be 40?
