Sessions Restores Police Power To Seize Property

Making America Steal Again! Yipee!


Attorney General Jeff Sessions just made it easier for police to seize cash and property from people suspected ─ but not necessarily charged with or convicted ─ of crimes.

He did it by eliminating an Obama administration directive that prevented local law enforcement from circumventing state restrictions on forfeiture of civil assets. The technique was embraced in the early years of the war on drugs, but it has since been linked to civil rights abuses: people losing cash, cars and homes without any proven link to illegal activity; police taking cash in exchange for not locking suspects up; a legal system that makes it hard for victims to get their possessions back.

Two dozen states have made it harder for authorities to take property from suspects without first securing criminal convictions. Three have outlawed it entirely, according to the Institute for Justice, a nonprofit that advocates for reform.

Local police got around those laws by asking federal agencies, such as the Drug Enforcement Administration, to take on forfeiture cases and then share the proceeds. That loophole, called "adoption," helped fuel an explosion in forfeitures, which became a multibillion-dollar government enterprise.

One of Sessions' predecessors, Eric Holder, issued a directive in January 2015 that prohibited the adopted forfeitures, which led to a drop in seizures. Police and prosecutors, who used the money to pay for new cars, equipment and training ─ and to help crime victims ─ hated it. They made it a key complaint to the Trump administration.

They found a sympathetic ear with Sessions, a former federal prosecutor and Republican senator from Alabama who has called for a return to 1980s-era crime-fighting strategies in defiance of a bipartisan movement to ease up in favor of rehabilitation and treatment. Sessions has already reversed a Holder memo that sought to curb the use of mandatory minimum prison sentences.

Looks like the feds are getting ready for a new or renewed war on ___ using that to seize and confiscate peoples property in violation of the 5th Amendment (again).

Watch for this to end up in the US Supreme Court on a constitutional challenge 'due process'

On one hand I am fine with this. Not caring too much what they do to criminals. In fact, instead of locking them up, take their house and their cars.

On the other hand, I can see a lot of potential for abuse here.

No one is crimal unless they are found guilty of a crime,. The reason this law was created was because of abuse. Cops were stealing cash from people in traffic stops claiming they must be deali g drugs if they carry a lot of cash.

The whole thing was a disgrace and now Trump/ Sessions wants them to do it again. This entire admin needs to be flushed down the dirtiest toliet on earth.

There was massive abuse of this law before and now there will be again. It turns law enforcement into criminals. They were scandals in many, many small towns that tourists would visit at different times of the year. The local police would spot an expensive motor home going down the road, make up an excuse to pull it over, do whatever was necessary to talk there way inside, and of course find drugs while inside planted by them and wala they now own your $100,000.00 motor home. Auction it off and divy up the money, sometimes with Judges and Prosecutors. That is why the law was abandoned. And now we will see the same thing as before. US citizens being robbed by law enforcement. Also Sessions reinstated mandatory sentencing which was outlawed because of abuse by prosecutors.

Moving backwards instead of forward under Republican rule. Sessions himself needs to be prosecuted for lying under oath which is a criminal act.

What they didn't mention in that news cast is this "judicial task force" isn't tied to any jurisdiction. They have officers from all over the state work this "task force" as a part time gig. 24/7 if you drive that section of interstate you see them pulling people over left and right along that 20-30 mile stretch of 40. Two spots they work mainly. Just before the Davidson county line and 840/40 interchange in Dickson County.. They have to have some kind of xray machines in their vehicles. They seem to get "lucky" all the time.

thank god my 3rd world shit hole protects its citizens from stuff like this...to get property seized you have to be convicted by the court for a specific crime and only then can they seize anything...
