I'm contacting you in an effort to take down a page I found on your website with my information but it's not me. The page is on xxxxxxx.com under the name "AVIA" from FTV site. The pictures are not of me, the links are to my business website and social media links. The photos and images are actually of my sister (we're twins) and she's been going through some emotional issues which she is addressing in therapy. She did some shoots for a site called FTV a few years ago, (she just told me about) and then posed as me in the paperwork and some comments. It's important to me for this page to be removed from your site because I am a model and I am an aspiring actress and it hurts my career if any google searches result in finding erotic photos of my sister, who looks like me. I'm doing everything I can to clear this up. I would greatly appreciate if you would please remove any of the pages on xxxxxxxx.com of "AVIA".​

Takedown should come from copyright holder. "Kara" should contact FTV and have them send takedown notices. Doubt that will happen since FTV still has her stuff up Avia on FTVGirls.com Released Jun 20, 2014!

We have had requests to remove images in the past. What I tell them is they have to reimburse money paid for the shoot, time it took to post the images or video, time to remove them AND loss of future earnings. Original cost + $300 + $300 + $1200

Well, once you get her to realize that lying to get her content removed is not the way to go about it you should explain all the costs associated with buying that content and suggest you are open to a buy out. Explain that even if you take down the content wherever you have posted it that there is no guarantee that it won't be renamed, pirated, etc and nearly impossible to remove completely. However, once she has paid for whatever you are out or whatever terms you agree to that she can freely dmca there on since in essence she would be buying back her rights (if in fact you are the original producer and own the rights).

Be polite and courteous and respectful that she is pained by the content being up but address the professional concerns/obligations and try to help her see the issues from your perspective. She doesn't want to ruin her life and you don't want to be taken advantage of. It is a crappy situation for everyone but can be dealt with in mutually acceptable fashion.

Ask for proof, then inform her that you will take down the content and then prosecute her twin.

no i have not linked to her website or twitter if it were a proper dmca i would of contacted ftv but the story is a bit much to believe no matter how nice they put it, i get a few of these a week but its ones like this i like to see what others would do

Let me revise my answer to, no, I would not take that down. I would let FTV know she was trying to destroy their traffic, however, because I'd want a SpookyCash affiliate to let me know if they got an email like that.

Content is property that has value. It should be treated as any other property. If you buy a car and the seller comes to you two years later saying "hey man, I want my car back..." You'd obviously say "fine, you can buy it back for xxxxx". Why treat photos and videos other than what they are?

My view is this.... I worked with tons of models. It's normal human behavior to want money today without thinking about future consequences. That is a behavior that producers exploit. No sane person could possibly think that it's unreasonable for an 18 year old to regret we decision in a few years. It's normal for someone to regret their decisions, particularly when most are making these decisions at a young age. Everyone should have the right to buy the content back based on some reasonable valuation formula that takes into account not only the pescitoom cost but its value to the business (ie when a single model is inordinately popular and also driving sales, used to promote the site etc etc).

Treat your business like a business. That should be something filed under "no shit" but it seems to me that almost no one in this industry gets that.

AND DO NOT follow far-L's advice and admit that you are aware you are causing emotional distress... that's grounds for a lawsuit. She doesn't need to understand your perspective.... she won't and she can't: she's not you, she's not running your business... she's someone who is in.a panic likely because someone saw her and recognized her,... It's unrealistic to think she's going to "understand". Explain the costs of production, the value of the content and give her a figure to buy it back. NEVER say anything more than you have to .... that's just simple business law 101.

Treat every business correspondence like you're about to get sued By the person you're corresponding with. Choose your words wisely. You'll never have a rational conversation with an irrational person, a sane conversation with an insane person, an honest conversation with a corrupt person or a reasonable conversation with an unreasonable person. Choose every word carefully as if it will be evidence against you. When you do that, you'll find you have a lot less to worry about in these sorts of exchanges. And DO NOT be baited into a back and forth, arguments etc where you'll eventually slip and say the wrong thing. Just resend your original, well thought out response.

If the links are for her business page and social media accounts, maybe you should start with removing those. Put at least some links those will bring you money. Or are you going to advertise her business? :)

That's basically what I do if it's affiliate based content. I never shot the content. I inform the person to contact the photographer/company and then I usually just remove it. It's not like it's the difference between eating or not. And certainly not like there aren't 1000 other models you can replace her with.

Things change, models move on, life goes on. It's just not a big deal to me to replace them.

I would ask for ID's of both girls before preceding. Something that shows they are twins. Then if that is the case, take it down. If not, she is lying and wait for a lawyer.

Assuming it is really her I'd probably just go ahead and take it down assuming you are just an affiliate. It would make me feel like a creep keeping her content up when she wanted it down.

If you were the shooter or the sponsor then I could see asking for a refund of your payment to her at the very least. Fair is fair.

I agree with the other suggestions that it is a good idea to notify the sponsor/content owner about this. Despite what they said though I personally would still remove the content. As crazy as it sounds from me I don't like pissing off people any more than I have to. :)
