"Facebook of sex" banned from bannering, what about...
 
So some companies mailt that running "facebook of sex" banners are not allowed anymore on their platforms/sties.

You think that soon fuckbook, sexbook, yourlocalsexbook and all other variations will be banned as well?

I am curious if facebook will also go after affiliates that pushed facebookofsex like stated in the lawsuit filed agains AFF. And even further go after the parties that hosted the banners (advertisementplatforms/hostingcompanies) that allowed affiliates to push them.

Facebook is getting arrogant since microsoft came on board, they handle the same style, hopefully this fb hype is over soon and a bubble will burst......not likely though ;)

true agreed, but the trend shows that they go after more, like they did with some other domains. I also seen many smaller domains being filed randomly, they send out letters to domains with book and face in it, thats harsh. Lets see if they go after the affiliates and how that would work, AFF should release those then in order for them to see them.

There was a woman who came on the show with Miss Lube or Ms Lube as her car garage/workshop. Clearly playing on the Mr Lube trademark.

Obviously you couldn't trademark the term "lube" but this obviously was infringement.

Same with fuckbook and sexbook I would think. But I don't know.

It is the affiliates that stand a chance of getting burned if they are pulled in to the fracas and end up having to pay their own attorneys.

They had to have known they would get sued for using "Facebook of Sex". If not then someone needs a brain transplant. How could the extra money made from obviously infringing on Facebooks trademark amount to more than the cost of attorneys and a large settlement?

There is a big difference between "facebookofsex" and other domains like fuckbook, sexbook, etc.. facebook "of sex" is clearly using their name and implying it's their adult version site.

The lawsuit also included 100 john does, which are the affiliates who were promoting facebookofsex, so once they get those affiliate's info during discover, then those affiliates will be sued as well. I doubt they going to go further after hosting companies etc... It's a big step to go out after affiliates, they will likely stop there.

Or the answer could be, uhoh spaghettios... who knows.

Facebook is a trademarked name.
AAF's facebookofsex contains that name — facebook.

Unless, facebookofsex can successfully challenge that trademark or trademark facebookofsex they will lose and possibly have a multimillion dollar damages award entered against them.

Facebook did try to trademark "face", and got a "notice of allowance" on it. Which means they need to file a "statement of use" in order to get it trademark.

apple is a lot more generic than facebook. facebook, relatively speaking really wasn't that popular of a phrase before "facebook.com" started using it. it is 100000000000x more popular now. I was in college until 99, i don't remember ever hearing "facebook" until it became a site.

It's not like AFF mentioned " come see our facebook" or some other text on one of their sites. They named their site facebookofsex" error!!
