Program owners: Would you accept an affiliate who owned your Domain.xxx to?
 

I curious what program owners will allow an affiliate, with their domain name .xxx to push traffic to them?



Companies like these , but not limited to these only:

Twistys.xxx

PORN.XXX

Brazzers.xxx (would maybe have trademark case)

BangBros.xxx (would maybe have trademark case)


There will be traffic generated and money to be had in sales.

It depends.

In one way it's trademark infringement and could be worth a lawsuit. Companies might decide fight to get the domain ownership back to them.

Then again, small companies could not afford to do it and instead might decide to team up with them to make money ("If you can't beat them, join them").

Then again the person who stole your name and is trying to make money with it adds insult to injury by offering to be your affiliate today, might dictate new terms tomorrow, etc. He's a dick, and nobody should do business with them.

According to the XXX registry website companies who own existing .com's might be grandfathered in, making domain squatting harder to do so this might be a non issue at least for a little while.

some programs dont even allow domains like bangbros-free-porn-vids.com

I believe that is against most BROgrams T.O.S.. Although I could be mistaken.

I would have to deny the affiliate on the grounds that they are not smart enough to do business with..

So I'm guessing that most of you program owners would do business with someone that bought your domain.xxx.

As long as they send the traffic to me, I could care less.

Saves me buying it.

how about if they register your solo girls name as a .xxx?

or something like lia19videos.xxx just as an example?

as long as its promoting our products strictly then sure - but as soon as its not then it would be addressed

Let's say the hypothetical affiliate does get permission from the affiliate program in question to send traffic from his {BrandName}.XXX to their {BrandName}.COM -- BUT it turns out that {BrandName}.COM doesn't conform to IFFOR's rules for .XXX sites (whatever those may turn out to be).... what then?

Will IFFOR permit the affiliate to continue promotion of {BrandName}.COM from {BrandName}.XXX, despite the fact that the .COM doesn't abide by IFFOR's rules and/or best practices?

Will IFFOR tell the affiliate that he can keep {BrandName}.XXX only if he does not promote {BrandName}.COM on the {BrandName}.XXX site/domain?

This is the sort of question that ICM should have been required to settle before ICANN would even consider their proposal/contract, IMO. For one thing, without answers to those questions and scores of other questions related to them, nobody knows how much or how little potential value .XXX sites will have.

If IFFOR allows linking from .XXX sites to .COM sites that don't conform to the IFFOR rules, then how meaningful are those rules, really?

In other words, can you still claim to be a "responsible" site operator if you link to sites that aren't similarly "responsible?"

I can't understand why any program would allow it

My take:

If you are a program/business owner and did not have the foresight to:

a)trademark your business name
b)buy a domain which you have clearly been notified you have first rights to or should know about if you are a savvy business professional

then it really seems like you shouldn't complain.

If you can't afford it, you should be happy someone else has purchased it and is sending you the business.

As for allowing an affiliate, it should be clearly defined in your TOS. Period. Not changed one day because you get pissed the domain owner is making money off your name and you feel it should be yours, yet you didn't even attempt to get it. Smart planning can avoid these issues clearly.

This is Business 101 - Cover your own Ass and protect your investment.
