and the hauge war crimes tribunal defendants got the same...by law you are innocent until proved guilty by a court of law and the court can give you a reasonable allowance...he lives in the largest property in new zeland and probably employs lots of staff and lawyers...

its a moronic point to make because this was probably a trade off for the paperwork errors made during his arrest...oh and its only :

I still think he will eventually cut a deal. It won't be anytime soon, but I think it will happen. I think that eventually the feds will be able to extradite him and his buddies. They will pull his buddies in one at a time and offer them all a great deal to turn on Kim. It is likely one of them will take the deal and agree to testify against Kim. If he has some very damning testimony (IE he goes on the stand and tells the jury that Kim knew they were breaking the law, but didn't care) it would be very hard for Kim to win his case. he is being made an example of. they know they can't go after the hundreds of similar sites. no other ones have been prosecuted. he is in an unfortunate position. he will do some time.

I agree. Just his arrest caused several sites to either shut down completely or modify the way that they work.

I think he will do some time, but I think he will cut a deal for himself, pay a big fine and do some time.

Of course, he might be arrogant enough to think he can walk away which could lead to him getting a hell of a lot more time.

you really have to spend some time reading the case and accusations...kim.com must prove bad faith on the part of the NZ police department when they made their paperwork error...in order to do this his lawyers must prove that the NZ police department actually had something to gain...good luck with that one LOL :1orglaugh ...

let me repeat for you: the hague war crimes tribunal defendants got the same deal...some of them got monthly allowances $20K+ and they were being tried for ethnic cleansing/mass murder/human organ harvesting ect ect....they did NOT win their case in court later on :1orglaugh ...

You know...if he somehow gets to keep most of his money, he'd make out pretty good getting out in a few years. I would have no problem doing a few years prison if I knew I had millions waiting for me. He's going to get sent to some low level 1 prison and have it easy. I remember being locked up with a 74 year old dude who made a shit ton of money off a scam he was doing...he got 8 years but when asked if he would do it all over again he said he sure as hell would. He was in bad health and he planned on using the money to go on cruises for the rest of his life and live it up lol.

Do you even understand the concept of getting off on a technicality. If you had to prove that bad faith to get evidence throw, all the police would have to do to get away with violating your right is to say "oops sorry it was a mistake".

There is an argument that they can simple back date the transaction the correct warrant but there is a bit of the problem, the government is now 100% aware that the seizure destroyed peoples legit backup. They would deliberately destroying legit property with full knowledge that what they were doing if they do that.

That has a liability.

there is no way that he gave up possibility of hamstring the US governments case (limiting them only to the evidence they collected before the arrest) for a income stream he will get anyway (as you pointed out).
