Adult publisher Perfect 10 is suing Tumblr for "rampant and unremedied uploading, display and distribution of Perfect 10's copyrighted photographs." The porn company says Tumblr did not comply with six separate DMCA takedown notices.

If you?ve ever wondered how sites like Tumblr get away with displaying copyrighted images, you?re not alone. Now one of the Internet?s biggest players ? the porn industry ? is eyeing Tumblr for copyright infringement.

Adult publisher Perfect 10 is suing Tumblr for $5 million for ?rampant and unremedied uploading, display and distribution of Perfect 10′s copyrighted photographs.?

In the complaint, Perfect 10 states that Tumblr?s reblogging platform allows ?subscribers to copy and distribute infringing content at the touch of a button.?

The complaint also states Perfect 10 sent former Tumblr president John Maloney six Digital Millennium Copyright Act (DMCA) email notices to take down the more than 200 images, but as of the date of the complaint filing, Tumblr had removed ?at most only a handful.?

This is a direct attack against Tumblr?s biggest defense, ?safe harbor laws,? which states that users ? not hosts such as Tumblr ? are responsible for copyright violations.

According to the porn company, ?Tumblr should be held liable for its failure to abide by its obligations under the DMCA and for willfully ignoring the widespread and uncontrolled copyright infringement pervading its website.? FULL STORY

Any outcome will be interesting to see.

The basis of the claim does not relate to image search, the making of thumbnails, and linking like was claimed in the Google lawsuit.

What is at the root is whether "safe harbor" was lost under the DMCA by Tumblrs inactions alleged.

I don't think it will affect DMCA...

I think closer to 15 if not more. I remember they have always been one of the most aggressive companies out there. I think they even sued some search engines or attempted to do so at one point for showing competitors or allowing competitors to bid on related keywords or something along those lines. It's been a while so I can't remember the details

I can never understand how MASSIVE TUBES with TERA BYTES of content stay online with no problems, but blogging sites with a few pics can get SUED or taken down...

Pretty crazy if you ask me.

Even small tubes, can get in serious trouble for having 5 vids.

YET, massive tubes with tera bytes of content cannot get touched... I don't get it. Somethign is missing here.

It's how youtube and others do it too. They take down videos or remove audio for which the uploader did not have the right to distribute. Not sure how quick they are, but they do it.

No, really dude... What the fuck are you talking about? Did you read the article? P10 is suing Tumblr because they did NOT heed the warning of the DMCA request. Here's the way it works... you use someone's content for your own purposes without the express permission of the content creator, and the company you steal from wins damages against you. DMCA takedown notices are requests sent to the service provider as a first-resort.

Brush up on some copyright law... jesus...

problem is you just cant have your cake and eat it too...

this is the one largest challenge in the adult industry.
in one corner you want your copyrights protected, on the other hand you want to "borrow" content for marketing purposes...

No, I don't want to "borrow" anything. I use tumblr to promote claudiamarie.com
That is what I was referring to. It's a great tool for promotion. As are all social media sites.

But people putting up stolen content all over them is going to ruin it for me. Sites like Tumblr will just want to get rid of the headache and kick porn people out.
