Don't use term PornTube!

I just realized that the term "PornTube" is a registered trademark of PornTube.com. If your tube domain name has this term(or planning to buy domain with this term), PornTube might sue you to transfer your domain to them. It is a fact!

Case:
Tenza Trading Ltd. vs. Calista Enterprises Ltd.

I thought i would share this here with other tube owners or those who are using this term unknowingly. FYI, PornTube may not send you a formal notice about the trademark violation.

Someone contacted us once because we had the term "Rev Share" in our text, claiming the phrase was trademarked. I was polite to the guy on the phone but never bothered to look it up.

Their case is still in litigation.

Indeed, this was confirmed by counsel. Spelling out "revenue sharing" is part of our style guide :2 cents:

If it is just a regular trademark, no legal action can be taken BUT if it is a registered trademark (with r-ball beside term), party has the full right to take someone to court for loss profit or to handover asset.

Not many webmasters search before they buy domain. But thanks for sharing this! I have bookmarked it.

I am not 100% sure about that but you could be wrong. domains.adrforum. com/domains/decisions/1491515.htm [add'em together and see the bottom decision part]

So content thieves sue others for using porntube, go figure.

AHarper 01-01-2014 01:49 PM

Wow, didn't know that. So the next one will register "TGP", "Gallery" and "Free Porn" as a trademark.

This way you can hold your competition down, too.

babymaker 01-01-2014 02:27 PM

Generic term, good luck suing.
