Question about Rape and the Inability to Consent.
 
I was watching the show Intervention last night, and the girl was hammered off her ass. She alleged that she was raped, and she called the police. The cop gave her a breathalyzer and she was very intoxicated (.26 or something). He said something in regards of the inability to consent since she was obviously plastered. But then he leaves and they never arrested the guy.

Did I miss something? Isn't it against the law to have sex with someone who is extremely intoxicated since they are unable to willfully consent? That's what they taught us during my freshman orientation, or has that changed?

97.6% of all sex in college is done with 1 or both of the participants drunk and/or wasted. What might seem like a good idea when sedated under the influence of alcohol might not seem so the next morning after waking up.

The cop probably determined from his talk with her that it was not worth pursuing due to circumstances he discovered after questioning her. In other words, it was not rape.
