DECEMBER 2--A Colorado landlord is facing a felony charge after a motion detection camera recorded him having sex with another man in a tenant's apartment, police report.

According to cops, Carlos Quijada illegally entered the Colorado Springs residence of Logan Pierce and Mikaela DiGiulio in late-November. While the married couple was not home, their four-camera Nest security system was guarding the condominium.

After Quijada, 39, entered the residence, Pierce received a notification on his phone that the Nest system had detected noise in the apartment.

When Pierce subsequently checked the camera feeds, he saw Quijada and another man inside his bedroom.

The video shows the men each removing their pants immediately upon entering the room and then climbing atop the bed. Following a six-minute round of oral and anal sex, Quijada's partner used one of DiGiulio's dresses--plucked from a laundry pile--to wipe his genitals. At one point, Quijada uses another garment to attack a lubricant stain left on the green bed sheet.

Pierce, who provided the X-rated security video to TSG, said that the blue dress used as a post-sex clean-up rag was worn by his wife at the couple's March wedding ceremony.

Pierce and DiGiulio--who rented the $1100-a-month apartment after responding in July to a Craigslist ad--vacated the premises shortly after Quijada used their home as a hook-up spot. The couple is now living at a Super 8 hotel where DiGiulio is employed (and where Pierce works part-time).

After being provided with the security footage, the Colorado Springs Police Department issued an arrest warrant charging Quijada with criminal trespassing, a felony, and misdemeanor obscenity.

Does not seem that fucked up to me. He is n his house while he knew (??) that tenants were away. Surely highly unacceptable, but in terms of what we see on the news that is pretty low on the fucked up scale. Gay angle adds some spice though.

That is seriously fucked up. I've been a landlord before multiple times. Even when my best friend was renting a condo from me I never entered the house without him there. In fact, I always knocked and he let me in. Very uncool.

Not sure about all US States but in California the law is clear. The landlord trespassed.

As a property owner myself I have walked in without advance notice (on tenants I suspect are sub letting, damaging the property, etc). All my agreements clearly state that I am not renting the entire unit, but sharing the place. It is structured to recognize me as a roommate/flat mate.

I only inspect the common areas (hallway, guest bathrooms, hallway closets, kitchen, living and dining room) and "look" but never walk into any of the bedrooms if the doors are closed.

Unlike most people, I try to learn from every one of my mistakes, and pay close enough attention to how people handle their own problems, so I don't have them.

A few brief tips for anyone that cares ...

#1. For regular folks (non lawyers) keep the verbiage simple and leave out the legalese.
#2. Agreements are written in the form of "We have agreed"
#3. All agreements include a brief cooling off period, giving them the right to change their mind.
#4. All parties are advised in the agreement that they have been given the opportunity to consult with legal counsel of their choosing, before signing the agreement.
#5. Each page of the agreement is initialed.
#6. Specific monetary damages are included for non compliance.
#7. Often the agreements are notarized.
#8. Reimbursement is expected (if we prevail) for incurred legal and collection of judgement expenses.
#9. Arbitration is required.
#10. Depending on the complexity (nature) of the business relationship, the signing of the agreement may be video taped. In this case, the effected party is asked to state their full name, date of birth, if they understand the agreement, if they understand their rights, if they are under duress of any kind, or under the influence of any alcohol or drugs/medication (legal or not).


If the matter still ends up going to court, lawyers seek a Summary Judgement to avoid losing more time and money over the issue. While no agreement is bullet proof, I can say, we have never lost yet.
