2257 and Amateur questions
 

Ok, this is what my lovely too expensive lawyer is telling me regarding the content swap so many Amateurs are doing now.

"Make sure their 2257 physical address of Releases, name of Custodian (not company) is listed on their site when you ad a promo pack inside your members area). Also you should list their Custodian of Records under yours, since it is their content and you do not have a model release on file for them. You can also provide a link to the Amateurs 2257."

Nice eh?

I am screwed. I have over 50 Amateurs promo packs inside my Members Area however only 2 have the legal 2257 on their site (see above).

Next step -- Remove all the Amateurs who don't have a legal 2257. urgh! or email them and ask them for a link to their 2257.

This is a nightmare!!!!

I do have model releases on some of the Amateurs (since we have done shoots with them)

This is terrible. I posted this because I know a lot of Amateurs (single girls at home moms, like me etc) peek here also and since I just got off the phone with Zack (my overpriced law expert grrr) I figure I let you all know.

I start doing it tomorrow.

just get the 2257 info from them. theres no reason they shouldnt give it to you.

If they're non-US amateurs they might not maintain 2257 regulations.

If they dont supply the info I belive you can serve them with a legal demand for it.

Don't want to sound like an ass, but, basically you're saying "Shit, I really should have called the lawyer BEFORE I got into this mess" ? Right?

You see how cautious lawyers are. :)

I could swear that this has been discussed IN DEPTH several times in the last 2 weeks.

What our lawyer said If you want to be 1000% safe yes you need 2257. If there are no sexual
acts on the pictures or lascivious showing of the genitals (whatever that
means than no. 2257 is for sexual performances, pictures, films etc

So we cleaned up the friends section, took out all the lewd and gross stuff but we get away with that because we dont do hardcore. So our members dont expect it but on all new friends pages if they dont have 2257 we are not doing it. Most wont have it because they are doing it at home and dont want to put their address up.
