we have her proper ID, and all model release forms signed by her.
I even have her on video saying how much she loves modeling for us!

now her new BF wants her off the site......
and she says she will sue us!

has this happened to any of you?
or any advice?

It would probably gain you more respect to take them down. Sometimes being the nice guy pays off in the end. But ask her to write a letter of her appreciation for your taking her pics down, and then post this on your site where her pics were. If you made some money off her pics then you still made money AND you get the respect of being "The Nice Guy"

This is just MY opinion though. I am not a content producer or anything like that. I just know when I was posting people's pics on my site and being able to make galleries of them, I'd be making a bit of money from the pics, BUT when they asked to have them taken down, I'd take them down. Had one girl who was about to lose her job because someone she worked with seen them and reported her. I took them down ASAP.

The situation is all so common. If you have the model releases and 2 ID's you OWN the images. If your model release notes "electronic distribution rights" you have no worries about using the images on the website.

The most common scenario we see in content is using images 15 years old and the now husband realizes its his WIFE! There is nothing they can legally do, and its to bad so sad for them. Alot of college girls do this for extra cash and almost always regret the "shoot" as they mature :-)

Seriously though....Lee said it best. My advice is to decide if you want to be a nice guy or not. If I were you I would offer her a buy out option. If you are not willing to take the pics down then call your attorney and run the situation and documents by them. Then call her bluff.

You should find a lawyer and ask their opinion. And think like a dumbass surfer would think... The problem with taking the photos down is you have already sold some of them (I'm assuming) and her boyfriend could some day find the images on somebodies site or gallery, then sue you for not remove the images from the internet. By talking to a lawyer, if you remove the for-sale pics or not, you'll know your legal rights.

My opinion is this. Why not just offer them a buyout? She took your money, you put in a lot of time to make the pictures, promote them, etc. Make a price and them let them decide if they want to pay it or not. That way if she really sues, you can show that you tried to be reasonable, too.

However, if you've already licensed the content out to other people, then they have to understand that you can't take back the already sold sets. The buyout would just be to stop you from selling more copies of the sets.

She got paid, so she has nothing to complain about really. But if you can be cool to her and get paid back what you put in plus a little profit, then you both can live happily ever after.

I agree with Tam.. plus.. in this day & age, contracts are as good as the people who sign them.. Judges are more and more saying that people have the right to change their mind. Contract or not.. It's just one gal.. not as if she's wantin to take your entire site down..

I'll go with Lee as to the ownership of the photos. You paid her, you have a release, and I'd hope proof of payment to go along with it, you own those images.

I'm sure if she really really wants to sue, she can find some sort of grounds to sue on, but chances are it won't be with a contingency lawyer so she'd have to have some money...

Kinda reminds me of a chick I know, she had some pics taken by a photog, who eventually sold his business to someone else, who then owned the pics.
