PITTSBURGH ? A husband and wife from California will each spend a year and a day in prison for distributing violent sex videos depicting simulated rape and murder.

Robert Zicari and Janet Romano also received two years of supervised release at sentencing Wednesday. They pleaded guilty in March to conspiracy to distribute DVDs purchased by an undercover U.S. postal inspector in Pittsburgh.

Zicari and Romano owned Extreme Associates Inc. of Northridge, Calif. The company distributed videos depicting violent sexual encounters.

Defense attorneys contested the government's claim that the material is "sadistic or masochistic" for sentencing purposes but that argument was denied.

Prosecutors say Zicari and Romano were full partners in the company.

Only if the fake rape in question is shown for purposes of sexual gratification. If it's shown to increase the gore factor in a horror flick, on the other hand, it's perfectly legal.

I'd say that is very accurate.

I'm still in favor of not pushing any violent content even in the horror flick and

these guys basically asked for it. This case has been going on for a while. There was a story on (I think) Frontline about them where they basically dared the government to come after them. If you ask for the bull, sometimes you get the horns.

It is pretty stupid though. Everyone involved are consenting adults and it goes back to my belief that the community standard rule shouldn't be allowed to be used in cases involving the internet because there is no community involvement.

That said I think the way sentencing goes if they got 1 year they would have to serve at least 9 months of it. With 1 year and 1 day they can be eligible for parole a lot sooner.

if you dare the government to come after you, expect them to come after you with both barrels.

The problem with this case is they were physically shipping tapes, so it wasn't an internet-based case.

What's crazy about Extreme Associates, is that if they had gone to trial and lost, they'd have done 4-5 times more jail time than they would if they had actually raped a girl.

Correct, but from what I understand the tapes were ordered from a website so in my eyes it is still the same. There is no community involvement. The only people that know you have that tape and are watching it is you and the people that sold it to you (and anyone you choose to tell or show)

But if you choose to challenge the government you better be ready for a huge fight.
