They have been aggressively sending out C&D's for years, got my first one from Nintendo.

:2 cents: though they seem to be selective about enforcing TMs. I had a nifty high traffic set of Wii domains a while back, had them for several months without any issues, and they weren't obscure names. I thought for sure anything with Wii that's parked they would go after but I guess not at that time at least.
