I even reported those sites to google for linkspam (at https://www.google.com/webmasters/to...amreport?pli=1)
and you should too because I did it a couple weeks ago and nothing has happened yet (they are probably just slow to react but man.. very slow indeed)..

So in theory I can blast my competitors sites with xrumer and then go cry to google that they are spamming, have them all de-indexed and reap the rewards? Ok sure....

There are over billion abandoned sites that are in internet junkyard unattended and are easily exploited by black hat apps. Most common are wordpress blogs.

However google does treat them case by case basis. Just because keyword anchor text appears on spammed guestbooks and comments doesn't mean the site owner is doing it. They look at these things very closely, but they do admit they can't police the whole web.

This exact question was asked last years at an Affiliate summit SEM Q&A, this was kind of the round about answer he gave
