As far as I know they don't "ban" anyone for using those. But you do not need to use this kind of plugin.

UK country lastly block porn sites which arent using this disclaimer. (What I read on the news recently)

legally, it's better to have a disclaimer if you have adult content, but not necessary a pop up.
