leedsfan 01-26-2005 03:17 PM

wow Chrles I remember you talking about the audit all that time ago on the boards...you were saying that the curacao trip was something they were trying to get you to pay for in full, and not use as a tax write off, like it should be...

It's taken a hell of a long time i guess, but I am very happy for you to hear that things have finally ended, and in your favour too.

way to go. I'll raise a glass to you tonight.

That was one of the big items I fought right through to the end. Thankfully, I was able to prove as a result of that trip, I brought in so and so income from certain sponsors and the appeals board accepted that even though that convention did not qualify as a convention according to the CCRA's definition of allowable conventions. I was willing to give up on this one item but my accountant kept saying we could win it, and he was right :)

They asked for it, I wouldn't release it. Their concern is the invoices and my bank accounts, as long as they matched, there's no grounds for any further investigation as far as I was concerned. If they're still suspecting suspicious activity, they are more than welcome to contact my sponsors. Luckily, they happened to be outside of the CCRA's jurisdiction :)

We're really in two different ballparks, my GST issue was open and shut because I'm a webmaster for US based companies. You owning paysites puts you in a completely different ballpark. But there is a great document my accountant referenced that includes a provision for paysite operators and membership sites that could work in your favour (Bulletin B-090 dated July 2002 from the CCRA). While it is old, it held up for me. I have the PDF so if you want it, email me (i forgot your email) and I'll send it to you. It has tons of examples and paysite owners fall directly into category 15 and category 2 (subscription based models).

Good luck on your upcoming case, and let me know how it goes. Could be very useful if I ever start a paysite on how GST holds up in your case.

Not without a court order. If you show you have co-operated with the CCRA (as I have done by showing invoices and bank statements), I doubt anyone would contest that. When I first met with them, they were really trying to intimidate me and trying to gather everything they could. As soon as I got an attorney involved, they backed off on almost everything. They can try to get it from you, but as soon as it gets to that point, consult your accountant, they'll tell you what they can and can't get.

I love how they act all intimidating...I try to tell most people that are getting audited to be prepared for a lot of accounting work, and possibly be ready to pay some money for back owing taxes, etc....but to not let it get to them other then that. CCRA is all about money, as long as you settle your account, they're not going to cut your balls off and throw you in jail. Accounting mistakes happen, they're there to make sure they get fixed and the account is settled.....but they act like they're judge, jury and executioner

lesbodojo 01-26-2005 05:17 PM

Congrats, hon. I'm sorry that you had to go through that in the first place.
