We're really in two different ballparks, my GST issue was open and shut because I'm a webmaster for US based companies. You owning paysites puts you in a completely different ballpark. But there is a great document my accountant referenced that includes a provision for paysite operators and membership sites that could work in your favour (Bulletin B-090 dated July 2002 from the CCRA). While it is old, it held up for me. I have the PDF so if you want it, email me (i forgot your email) and I'll send it to you. It has tons of examples and paysite owners fall directly into category 15 and category 2 (subscription based models).

Good luck on your upcoming case, and let me know how it goes. Could be very useful if I ever start a paysite on how GST holds up in your case.

Not without a court order. If you show you have co-operated with the CCRA (as I have done by showing invoices and bank statements), I doubt anyone would contest that. When I first met with them, they were really trying to intimidate me and trying to gather everything they could. As soon as I got an attorney involved, they backed off on almost everything. They can try to get it from you, but as soon as it gets to that point, consult your accountant, they'll tell you what they can and can't get.

I love how they act all intimidating...I try to tell most people that are getting audited to be prepared for a lot of accounting work, and possibly be ready to pay some money for back owing taxes, etc....but to not let it get to them other then that. CCRA is all about money, as long as you settle your account, they're not going to cut your balls off and throw you in jail. Accounting mistakes happen, they're there to make sure they get fixed and the account is settled.....but they act like they're judge, jury and executioner
