I never said that you didnt get screwed on the original deal. But you agreed to it. You cant pay someone on a 50/50 partnership and then a year later say he didnt deserve it, therefore im not paying him now for something else which is exactly what you're doing. You're saying you'll pay the $500 for the banners you've been using but you're subtracting the $582 that you have already paid. However that $582 has nothing to do with these banners. That was part of an agreement that you made. No matter how shitty the deal was, you cant just decide that the $$ paid out was for something else.

Do you have this original contract that says exactly what the $500 was for and what you would be getting for the 50/50 partnership? If you don't then it's just your word versus his, and to be honest, it's not looking too good for you. And the fact that you are using his banners for your other projects and not sending to the original tour you both agreed upon, shows that you breeched the original contract, if indeed there is a contract.

Fletch does good work and while alot of people don't understand the design business, it takes alot of time and creative ability to keep coming up with something that is unique and fresh. When he originally designed the site for you, it was uniqe and fresh and converted. Don't downplay the fact that he is a good designer, after all, you are still using the banners he designed.

I have our email conversations, ICQ conversations, and cancelled checks. Neither of us have written contracts one way or another.

His banners were selected by someone else, not me. I liked the banners. But then again, I liked the tour, too. It just didn't convert very well. Regardless, who knows if the banners would work or not... they hadn't been tested. Affiliates were not using banners, as they used hosted galleries.
