I'll go with Lee as to the ownership of the photos. You paid her, you have a release, and I'd hope proof of payment to go along with it, you own those images.

I'm sure if she really really wants to sue, she can find some sort of grounds to sue on, but chances are it won't be with a contingency lawyer so she'd have to have some money...

Kinda reminds me of a chick I know, she had some pics taken by a photog, who eventually sold his business to someone else, who then owned the pics.

Course the chick piddled around for two years or so, not buying the rights to the photos when they were offered to her, and one day found herself staring at herself on the front of a cd case at Internext.

demand the modeling fee back and your studio time back in cash and sell the pics and sole licence back to her. Not worth the hastle, but if she isn't willing to give you the money you paid her (plus your studio time - at a REALISTIC REASONABLE RATE) then goto court and sue the ugly hoe.

If her lawyer is worth anything he'll agree to that, it more than fair as you loose profit in not selling the pics but you shouldn't have to loose your initial capital to do the shoot if she wants to break a contract. To me that seems to be the least waste of your time in the matter.

I would contact an attorney and make sure your release is bulletproof....then tell her "tough shit".....look at the pics of celebrities that re-surface after all these years and there is nothing they can do about it..and they even have GOOD attorneys....

You have her on videotape agreeing, so she can't claim she was forced...this is why when my partner does the shoots, everything is videotaped (not in a content manner, but in a "documenting the shoot" and covering the proverbial ass manner)

If she doesnt understand that, then she shouldnt have signed the release.

you can offer to sell her the rights of those images, but there might be a problem with the sets you already sold, since she now owns the rights to those set of images.. In other words she now owns the rights to those images and she might be able to sue the webmasters who bought them. There maybe some kind of loophole there.

Really consult a lawyer before any decision is made, and make sure all ramifications of selling those rights back to her are defined.

Also these are costs that you will have to get reimbursed on. So she will end up paying dearly for changing her mind

Not to sounds redundant, but I am assuming the language on the model release is clear. The most important statement in the world is really reduced to few words, and those words are the description of the rights you had permission for such as print and online [electronic], and in some case a timeline if any.

Its always wise to contact an attorney, but having been the most sued webmaster since 1993 with copyright and model release challenges, I can tell you, she has NO standing, and unless she has a potload of money, she cannot even challenge you. To challenge you with a frivolous lawsuit will cost her twice, her fees and having to pay yours.

She was compensated [assuming you paid her & you can prove payment], you have signed releases [contract].

Having been dealing in content since 1991, I lost count of how many times we were challenged with the model or family up in arms over the conduct of their loved ones posing nude or comitting a sexual act....even had some claim their loved one was a minor at the time the images were shot and they did turn me into the Child Porn divison in CA.

My paperwork never failed me, and NO district attorney is gonna take her case because she had a change of heart and has asked you to stop distributing images...

If you want the images, they are yours, have fun, if you want to make concessions and pull them, its your choice, but if you choose to its not because you legally had too.

Now, on the other hand models tend to like to report photogs to authorities telling them bad things go on in the studio's, and sometimes this leads to a sting and computers get hauled out until your case is sorted out.....she could really put you through some changes........some call local community folks and they want to investigate your activities....

If you think she is gonna be the bitch from hell, decide how bad you want those images and are you willing to go to war over them....

I agree with Lee 100% - You own those photos, end of story.

We've had this problem a number of times. Normally we give them the phone number of our attorney and that's the end of it. These girls have problems keep their phone bill paid; I doubt any of them would go as far as to contact an attorney.

On the other hand, in a number of cases we've taken the photos down.

Once a model asked us not to post the pictures a day after the shoot. We weren't too happy with the photos, so she returned the money she paid to us and we destroyed the pictures.

In other case one of our more popular models had a problem with her photos being printed up and passed out at her old high school, church, and other places in her home town. We liked this model and took the pictures down for a while until things settled, then put them back up in our member's area.

It's all about how you want to deal with it.

That's why you have them sign a release! The release says they don't mind where the photo or used or how. It holds you harmless for anything undesirable that happens as a consequence, etc. It usually also says that they've read the release through and are signing it after giving it due thought, that they weren't under duress, and so on. Releases can be set aside, but they require a better reason than that it hurt their reputation.

You guys deal a lot in repeat business, and if I buy a set today, and then I am told months from now that I have to remove the pictures or be subject to litigation by the model who bought her pics back, that's one provider I'll never do business with again. (and imagine the nightmare involved for webmasters who used the images for banner and tour designs)
